1. DEFINITIONS 

  1. We, us and similar pronouns means Triple SC & MN Walker Scaffolding Ltd. 
  2. You, mean the customer to which we supply scaffolding.  
  3. Hire Period, means the period from the date of installation of the scaffolding to the date you notify us that the scaffolding is ready for removal. 

2. GENERAL 

  1. This Contract does not confer or purport to confer any benefit on any third party. In particular, rights that would otherwise arise in favour of third parties under the Contracts (Rights of Third Parties) Act 1999 are hereby excluded.
  2. We will advise you if you need a pavement licence for the scaffold. Our charges for obtaining a pavement licence will be included in your quotation. You are responsible for any planning or other consents.  
  3. You must ensure that the site is clear of obstructions, accessible to our vehicles and personnel, that you obtain any access passes and complete any paperwork required for our personnel to attend and work at the site. You will be charged if we are delayed due to failure to fulfil these responsibilities. 
  4. These Terms and Conditions and any document expressly referred to in it represents the entire agreement between the parties and supersedes any prior agreement or arrangement whether oral or in writing. 
  5. Neither party has any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the Installation Start Date (unless such untrue statement was made fraudulently) and a party’s only remedy shall be for breach of contract as provided in these terms and conditions. 
  6. No term of these Terms and Conditions shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by a person who is not a party to these Terms and Conditions, but this does not affect any right or remedy of a third party which exists or is available apart from under that Act. 
  7. Nothing in these Terms and Conditions excludes any liability we may have for death or personal injury resulting from our negligence. 

3. QUOTES & PRICING 

  1. The price included in the quotation is for 6 weeks of hire from date of erection, hire any longer than the 6 week period is chargeable and will be charged at 5% of the total quoted price, per week of additional hire. This will increase to 7.5% after 12 weeks until we have received 5 clear working days confirmation from the hirer that the scaffolding is no longer required and is ready to be dismantled. 
  2. Quotations are valid for 1 month from the date of issue.
  3. Please note that any additional/alterations, unless otherwise agreed by us, require a separate examination at the cost of the customer. This includes providing ‘Scaff tag system’, which will be charged as per the quoted rates or the minimal charge of £50.00 per Scaff tag/examination.

4. SUPPLIER OBLIGATIONS 

  1. Triple SC & MN Walker Scaffolding Ltd will ensure that the scaffold is designed and installed safely and will be suitable for normal use. You must tell us in advance if you have any special or unusual requirements. 
  2. We will do our best to meet any dates advised to you, but we may be delayed by circumstances out of our control (including but not limited to, poor weather conditions that would make it unsafe for our personnel to carry out installation work, vehicle breakdowns or sickness). You should always allow an adequate time contingency in your project plans to account for the possibility of such delays and we are not liable for any losses you may incur arising from any delays. 
  3. HOC (hand-over certificates) and compliance certificates are supplied by us as standard with all completed works.

5. CUSTOMER OBLIGATIONS 

  1. You are responsible for taking care of the scaffold throughout the Hire Period and we will charge you for any loss, theft, damage or neglect other than fair wear and tear. 
  2. The customer is required to notify us of any cancellations as described in ‘7. Cancellation’. 
  3. The hirer must give the owner no less than five clear working days’ notice to off hire the scaffold, before the expiry of the minimum period of hire or extended hire period, and in the event of such removal there shall be no reduction in the contract price or additional hire price.

6. PAYMENT  

  1. Payment is due on receipt of invoices. Invoices not paid within 7 working days of the date of invoice will be subject to late payment charges. 
  2. Prices  are  subject  to  VAT,  which  will  be  added  at  the appropriate rate.
  3. We have the right to charge interest on late payments at the rate prescribed from time to time under the Late Payment of Commercial Debts (Interest) Act 1996 and in addition shall be entitled to recover all reasonable costs incurred in recovering any unpaid sums.   
  4. Interest will be charged at 5% of the invoice amount up until 30 days post due date. Any invoices remaining outstanding after this period will be subject to the 5% interest as well as an additional 1% per week for each week the invoice remains outstanding.  
  5. We are entitled to charge extra if the Hire Period exceeds the period in our original quotation at our standard rates. 

7. CANCELLATION 

  1. Customers are required to notify us of cancellation of accepted works within ten working days of accepting the quotation. 
  2. Scheduled works that have agreed dates and times require a minimum 48 hours’ notice. 
  3. Failure to adhere to cancellation terms will result in a 50% of the total job cost cancellation fee. 
  4. Any urgent jobs scheduled at short notice that are cancelled will be subject to pay the full cost of the works.   

8. PROPERTY AND RISK 

  1. The scaffolding shall remain the property of the owner and nothing in this contract shall confer or be deemed to confer any interest in the scaffolding to the hirer
  2. If you fail to make any payment when due, then we (or our agents) may enter onto the site to remove the scaffold and our personnel or agents cannot be prevented from entering onto the site in order to exercise this right. 
  3. Any injuries sustained from any unauthorised persons using the scaffolding is not Triple SC & MN Walker Scaffolding Limited liability. 
  4. Any damage to property, vehicles or persons caused by our scaffolding that has resulted from adverse weather conditions or movement from unauthorised persons is not Triple SC & MN Walker Scaffolding Limited liability and we are not liable for any costs incurred as a result of any such damages. 
  5. Upon the termination of this contract, whether by effusion of time or otherwise, the owner may, without notice, retake possession of the scaffolding and for that purpose may by ourself, our employees or agents without previous notice, upon any land or premises on which the scaffolding is, or is believed by the owner, to be situated. 
  6. Triple SC and MN Walker Scaffolding ltd reserves the right to advertise on all our scaffolding.

9. LIMITATION OF LIABILITY 

  1. Our maximum liability for any loss arising from our breach of our obligations to provide the Installation in accordance with these Terms and Conditions, in tort (including negligence) or otherwise is limited to a maximum of the total of our charges received by us from you in the period of three months prior to the date of any claim by you. A series of connected claims related to a single event or occurrence shall be deemed to be a single claim for the purposes of this clause. 
  2. We are not liable for any injury resulting from use of scaffolding by any person other than your suitably trained and qualified personnel. 
  3. Triple SC & MN Walker Scaffolding Limited cannot be held liable for any damages or breakages which may result from erecting scaffolding on or over a fragile surface/structure. I.e. glass roofs, temporary roofs, chimney stacks, etc. 

GOVERNING LAW 

  1. These Terms and Conditions are subject to the law and jurisdiction of the Courts of England and Wales.
